How HRA Exemption is Legally Determined (Rule 2A)

Under Section 10(13A) of the Income-tax Act, 1961, the exempt HRA is strictly the lowest of these three statutory amounts:

  • Limit 1: Actual House Rent Allowance received from employer for the period.
  • Limit 2: Rent paid in excess of 10% of salary (Basic + DA forming part of retirement benefits).
  • Limit 3: 50% of salary for residential accommodation in Metro cities, or 40% for Non-Metro cities.
